Terms and conditions

The terms on which this website is provided, and on which enquiries and quotations are handled.

About this document

This is a first draft prepared for AIRDM Ltd and written for a UK business. It covers use of this website and the handling of enquiries only; it does not set commercial charter terms such as pricing, deposits or cancellation charges, which are issued separately with each quotation. Items in square brackets are company details still to be confirmed.

01 Website use

These terms apply to your access to and use of the AIRDM website. By using the website you agree to them. If you do not agree, please stop using the site.

The website is operated by AIRDM Ltd, a company registered in England and Wales under company number 14476168, with its registered office at Air DM Ltd, Windsor House, Bayshill Road, Cheltenham, Gloucestershire, GL50 3AT.

You may view, download and print pages from the website for your own use in connection with a genuine enquiry. You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious code, or use it in any way that is unlawful or that could damage or impair its availability to others.

We may update, suspend or withdraw all or part of the website at any time without notice. We do not guarantee that the website, or any content on it, will always be available or uninterrupted.

02 Intellectual property

All content on this website — including text, photography, video, graphics, layout, design and the AIRDM name and marks — is owned by AIRDM Ltd or used under licence, and is protected by copyright and other intellectual property rights.

You may not copy, reproduce, republish, distribute, adapt or commercially exploit any part of the website without our prior written permission. Photography of the aircraft may not be reused for commercial purposes.

Nothing on this website grants you any licence or right in our intellectual property other than the limited permission to view the site as set out above.

03 Accuracy of information

The content on this website is provided for general information about AIRDM and the services we offer. We take care to keep it accurate and current, but we do not warrant that it is complete, accurate or up to date at all times.

Descriptions of the aircraft, services and typical journeys are indicative only. They do not form part of any contract and should not be relied upon as a statement of what can be delivered on a particular date.

Nothing on this website constitutes advice on which you should rely. If a detail matters to your plans, please confirm it with us in writing before making arrangements.

04 Enquiries

The enquiry form on this website is a request for information. It is not a booking engine, and submitting an enquiry does not reserve the aircraft, confirm a date or create a contract between us.

We will use the details you provide to understand your requirements and respond. Please make sure the information you give is accurate — particularly dates, locations and passenger numbers — as it affects the proposal we prepare.

Personal information submitted through the form is handled in accordance with our privacy policy.

05 Charter quotations

Quotations are prepared individually in response to an enquiry and are issued in writing. Each quotation sets out the flight as we understand it, together with the commercial terms that apply to it.

A quotation is an invitation to proceed, not a confirmed booking. A charter is confirmed only once we have accepted it in writing and any conditions stated in the quotation have been met.

Quotations are valid for the period stated on them. Where no period is stated, please treat the quotation as subject to reconfirmation. Any commercial terms — including payment, amendment and cancellation arrangements — are those set out in the quotation and accompanying charter documentation, not on this website.

06 Availability

AIRDM operates a single Robinson R66. Availability is therefore limited and is confirmed on a flight-by-flight basis at the time of booking.

All flights are subject to weather, daylight, airspace, landing site permissions, aircraft serviceability and crew availability. The pilot in command has final authority over whether a flight may safely proceed, and may delay, reroute or cancel a flight on safety grounds.

Where a flight cannot proceed, we will discuss alternative arrangements with you. Any consequences for the commercial terms are governed by the quotation and charter documentation rather than by this website.

07 Pricing

We do not publish fixed prices or fixed routes on this website. Every flight is planned around the client's requirements, and pricing is confirmed in the written quotation.

Where a figure is discussed informally, it is indicative until confirmed in writing. Costs that depend on third parties — such as landing fees, handling or parking — will be identified in the quotation where they are known at the time.

08 Third-party links

This website may contain links to third-party websites or resources. Links are provided for information only and do not imply that we endorse the linked site or its content.

We have no control over the content of third-party sites and accept no responsibility for them, or for any loss arising from your use of them. Third-party sites are governed by their own terms and privacy policies.

09 Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Subject to that, we exclude all implied conditions, warranties and representations relating to this website to the fullest extent permitted by law, and we are not liable for any loss of profits, loss of business, loss of anticipated savings, or any indirect or consequential loss arising from your use of, or inability to use, this website or from reliance on its content.

Liability in connection with a charter flight is governed by the charter documentation and by applicable aviation law, not by these website terms.

If you are using the website as a consumer, these terms do not affect your statutory rights.

10 Force majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control.

Such events include, without limitation, adverse weather, airspace restrictions or closures, acts of government or regulatory authority, industrial action, fire, flood, epidemic, civil disturbance, failure of utilities or communications networks, and unforeseen technical faults affecting the aircraft.

11 Governing law

These terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the law of England and Wales.

The courts of England and Wales have exclusive jurisdiction over any such dispute or claim, save that consumers resident elsewhere in the United Kingdom may bring proceedings in their local courts.

We may revise these terms at any time by amending this page. Please check it periodically; the version in force is the one published here when you use the website.
